Probate - John Shankland 1740 - 7 p.In The Name of God Amen the Tenth day of April and year of Our Lord One
Thousand Seven Hundred and forty I Jahn Shankland of the Town of Lewis and
County of Sussex upon Delaware being Sickly and in a weak and Longushing
Condition of body but of a Sound and perfect mind and Memory thanks be unto
God for it Calling to mind the Mortality of my body and knowing that it is
appointed for all men once to dye do make and ordain this to be my Last will
andTestament hereby revoking annulling and making void all other wills or
Testaments which might have been formerly made by me wither Muncupative or
written having Committed my Soul into the hands of God who gave it and my
body to the Earth to be decently buried at the discreationof mine Executors
hereafter Mentioned and constituted nothing doubting but at the Generall
resurrection I shall receive the same again by the Almighty power of God and
hoping through the merrits of Christ mine only Saviour and Redeemer to
obtain an Inheritance among those who are Sanctified And as to what worldly
Estate wherewith God hath been pleased to Bless me in thisLife I give have
and bequeath in Manner and form following after all DebtsJustly due by me
are paid and Funerall Charges defrayed
Inprs. I Leave and bequeath unto my dearly beloved wife Mary Shankland One
Third part of my
real Estate Together with my dwelling House and Garden during her Naturall
Life she being
Obligged to maintain and Leave the house in such repare stte and Condition
as she receiveth and
Entereth to it and not to make wast on any part of my real Estate as Also
One Third part of my
personall Estate as the Law hath provided in that Case to widows
Also I Leave and bequeath to her One Looking Glass now Standing in my bed
room up the stares
Together with a Chest of Draws now standing below stares in a Shed room with
a Corner
Cupboard and Jepand Tea Table and my big house bible with Two Cows and
Calves The value
of which Two Cows and Calves I order her to give to my Son David at her
decease if he be then
Living and if he be dead to my Son David at her decease if he be then Living
and if he be dead
to my other Child she now is with if Then Living
Item I Leave and bequeath to my son John Shankland my dwelling House in Town
Store House
Smiths Shoop Kitchen and Smoak House Togather with the Gardan and Lott or
Lotts lying betwixt
my Garden and grave yard or burying place belonging to the Presbyterien
Meeting House Also
all my part of an Island of Marsh inLewis Creek Also a small parcell of wood
Land on the South
East side of my brother Joseph Shanklands Tract being a ;part of the same
Tract or Devidend of
Land Commonly called by the name of Saint Martins bounded as by my late
deceased Father
William Shankland will will more plainly appear also all my Took belonging
to my Trade as
Bellowses anvill Hammers &c. Together with my writing Desk Clock my Gold
Buttons shoes and
kne Buckels with all my riding Furniture as Sadle Bridle &c Reserving always
the benefits of my
part of the above said Island of March to my dear wife Mary Till my Son
Marrie or be capable to
Discharge Mine Executors according to Law
Item I Leave and bequeath to my son David Shankland that Tract or plott
ofLand Lying betwixt
the Two ponds commonly called Calfe pasture (Turn over) Brought over) with
all appurtinances
there unto belonging Together with Twenty five pounds this Currancy as a
Legacie to him always
allowing to my dear wife Mary the Benefit of Said Pasture of that Tract or
plott of Land Till that
David Shall marrie or be capable to Discharge Mine Executors after mentioned
in Law Together
with the Intrest of Said Twenty five pounds of this Currancy Towards the
Charges my dear wife
May be at in his Maintainance Cloathing and Schooling Till he arrive to the
age of fourteen years
which if my wife Except not I order and appoint that the benefits afsd Calfe
pasture the Intrest of
said Twenty five pounds and the benefit of my part of the Island of Marsh to
be applyed to the
defraying the charge mine Executors may be at in Maintaining Cloathing and
Schooling of my said
son David Till that he arrive to the aforesd age of fourteen years
Item I Leave and bequeath to my daughter Sarah Shankland the One Equall half
of the severallparcells of Land Lying and Joyning to Simon Kollock Esqr his Tract of Land
on the South westside Together with an Equal half of that Tract of Land Scituate at or near
ly the Deep Valley
Taken up by a warrant betwixt my Late Brother Robert Shankland and me also
my chest and of
Draws Now Standing in my bed room above stares as also one bed well
furnished with Two pares
of sheets Bolster Two pillows Cases blankets and Quilt also a pare of Small
Schizers and Silver
Chane which was her Late dear Mothers also my negro man called Cesar a young
Horse four
years Old this spring Together with Three Guineas or the vallue of three
Buineas to by her a pare
of Gold Buttons and Sadle and Bridle as Also Ones small Dressing Glass
standing in afrain in One
of the Shed rooms below stares Together with a small Silver spoon and a
Childs silk mantle given
to her by her Late grand mother Jane Hall
Item I Leave and bequeath to my daughter Esther Shankland the other LEqual
half of the severall
parcells of Land above mentioned Lying and Joyning to Simon Kollock Esqr his
Tract of Land
on the South East side Together with an equal half of the above mentioned
Tract of Land Situate
at or nearly the Deep Valley Taken up by a warrent betwixt my late, brother
Robert Shankland
and me also my Negro boy Commonly called black Sam a Large One Black Walnut
Table a Small
dressing Glass nowLying in the Chest of Draws standing in a Shed room below
stares one bed
Two pillows and pillow cases Two pare sheets Blankets and other furniture
necessary for One bed,One cow of her Own Choice from Out of all my cows for the One I killed
belonging to her which
cow was left her by her late deceased Grand Father William Shankland as also
give Guines on the
Vallue of five Guines to buy her One gold Ring Gold Buttons a Sadle and
Bridle and One young
horse at the Indian River with a small pocket bible which belonged to her
dear Late Desed mother
Item if it shall please God my dear wife Mary be delivered of the child she
now is with and it Live
I Leave and bequeath to it Fifty pounds of this currancy, the Intrest of
which Fifty pounds of this
currancy, the Intrest of which Fifty pounds I order and appoint to be paid
yearly and Every year
to my dear wife Mary Towards the maintaining and cloathing of paid child if
it shall Live
Together with five pounds of this currancy Towards the defraying of her
Inlying to be given to
my said wife Mary Shankland Over and above what is appointed to her as above
Item I Leave and bequeath that after all Debts Justly due by me are paindand
Funerall charges
defrayed and the Severall Legacies as above mentioned are paid and
discharged I order and
appoint that whateer Remainder there may be whether of my real or personall
Estate not disposed
of as above Directed it be Equally Divided among all my five children
hereafter named as follows,
Viz John David Sarah Esther Shankland and the Infant or child
Item My will and pleasure is that if it shall please God the child my dear
wife is now with should
dye that then what I have left and bequeathed to said Infant or child as a
Legacy I order and
appoint that Legacey of Fifty poundleft and bequeathed to it shall be
Equally divided betwixt my
other Surviving Children Viz: John David Sarah and Esther Shankland
Item My will and pleasure is if God should please to remove by death my Son
David before he
Mary or be capable to discharge mine Executors according to Law, I order and
appoint that His
real and personall Estate now Given to him by this my Last will and
Testamentshall be Equally
devided among all my Surviving Look up Surviving Children hereafter named as
followeth (towit)
John Sarah and Esther Shankland and the Infant not yet born if thenLiving-
Item If God shall please to remove by death both my Son David and the child
my Dear wife is
now with before Their marrage or their being Capable to discharge mine
Executors according to
Law, Then I order and appoint that their Estate both real and personall
shall be Equally devided
betwixt my other Three children (viz) John Sarah & Esther Shankland
Item my will and pleasure is that if in the providence of God my Daughter
Esthea Shankland be
removed by death before her marriage or she be in Law capable to discharge
mine Executors Then
I order and appoint that both ;her real and personall Estate shall be
Equally divided betwixt my
Son John Shankland and Daughter Sarah Shankland
Item My will and pleasure is if God shall please to remove by death my
Daughter Sarah
Shankland before her Marrage or she be capable in Law to discharge mine
Executors Then I order
and appoint that her real and personall Estate shall be Equally divided
betwixt my son John
Shankland & Daughter Esther Shankland
Item My will and pleasure is if God shall please to remove by death my son
John Shankland
before he marrie or be in Law capable to discharge mine Executors then I
order and appoint that
his real and personall Estate shall be Equally devided betwixt my Two
Daughters Sarah Shankland
and Easther Shankland
Item My will and pleasure is if in the providence of God any Two of my Three
Eldest Children
(viz) John Shankland and Sarah Shankland or Esther Shankland be removed by
death before they
are capable in Law to discharge mine Executors or be married ThenI order and
appoint that the
real and personall Estates of both there deceased Children shall desend and
be given to the other
Surviving child whether it be John Sarah or Easther Shankland
And for the full perfecting of this my Last will and Testament I ordain
Constitute and appoint my
very dear brother Joseph Shankland and cozen William Shankland Executors
thereof and I hope
and nothing doubt their faith fullness as Executors of this my Last will and
Testament and their
care to do Justice to Every of my very dear Children and I also Earnestly
beq and intreat the Revd
James Martin and my brother Peter Hall to Take the oversight and charge of
my poor orphant
Children that they are to behove Councell and direct them how they are to
behave and Ought to
Cary themselves and I do in the words of a Tender and Dying Father Earnestly
Require yea
strictly charge and command my children to act and behove themselves
according as they shall
be advised and Directed by these above Mentioned whom I appoint as overseers
of this my Last
will and Testament that mine Executors Every of the above clauses and
Articles so far as my real
and personall Estate will allow & I having declared this to be my Last will
& Testament in the
presence of the under Subscribing witness In Testimony thereof
have signed it with mine own hand and affixed my Seal the day and year first
within written
